1. Introduction

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
EvenFieldCommonSpark offers luxury yacht charter services, which include but are not limited to:
- Daily yacht charters
- Evening sea voyages
- Business getaways
- Exclusive gatherings
- Prolonged sailing trips
Service availability is contingent on weather patterns. Our rights include altering or withdrawing services at any given moment.
3. Booking and Reservations
3.1. Booking Process
In order to reserve a charter, you’re required to:
- Have at least 18 years of age
- Submit correct and complete details
- Render the necessary deposit as indicated in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Booking confirmation is secured only after the payment is received and affirmed in writing by us. We retain full authority to deny service to any individual at our discretion.
3.3 Availability
All charters are subject to ship accessibility and favorable weather conditions. We will endeavor to accommodate your requested dates and times where possible.
4. Payment Terms
4.1 Pricing
All fees are provided in € and include taxes as applicable unless stated otherwise. Prices may vary without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost due at the time of reservation
- Balance: Expected 48 hours ahead of the charter departure time
- Additional fees (as necessary): Payable upon the conclusion of the charter
4.3 Payment Methods
We process payments through major credit cards, wire payments, and certified cheques using secure and encrypted procedures.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete reimbursement less transaction charges
- Between 24-72 hours prior to departure: Half the amount will be refunded
- Under 24 hours before departure: No reimbursement offered
5.2 Weather Cancellations
In the event that our captain deems weather conditions as unsafe, we commit to:
- Propose an alternate charter date at no extra cost
- Issue a full refund when rescheduling is not viable
5.3 Mechanical Issues
If your designated vessel encounters mechanical failure, we will make an effort to provide a comparable alternative. If an alternative is not available, a complete refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All aboard are expected to:
- Heed all instructions given by the crew
- Utilize safety gear when mandated
- Disclose any medical conditions that could affect their safety
- Remain within the boundaries of the allotted areas on the vessel
6.2 Restricted Items
Items that are not allowed on board include:
- Containers made of glass
- Forbidden substances
- Firearms or other weapons
- Non-alcoholic beverages beyond moderate consumption
- Pets (unless pre-approved)
6.3 Behaviour
Passengers must behave in a courteous and respectful manner. We reserve the right to end a charter prematurely without refund if passenger conduct endangers safety or interferes with other guests' enjoyment.
7. Liability and Insurance
7.1 Our Liability
We are only liable upto the cost paid for your charter. We are not responsible for:
- Injury arising from passenger carelessness
- Loss or harm to personal items
- Indirect, consequential, or punitive losses
- Delays due to weather or events outside of our influence
7.2 Insurance
We hold a comprehensive marine insurance policy that covers our fleet and operations. Passengers carry the responsibility for their own travel and personal insurance coverages.
7.3 Acceptance of Risk
By partaking in our charter services, you acknowledge the intrinsic risks associated with marine activities and accept responsibility for your own safety and welfare.
8. Adjustments and Itinerary Changes
We keep the right to alter itineraries, pathways, or timetables based on climate, safety issues, or other operational needs. We will strive to ensure comparable alternative experiences are offered wherever applicable.
9. Exemption for Force Majeure
We hold no liability for delays, cancellations, or modifications that are due to forces beyond our control. This includes but is not limited to:
- Severe meteorological events
- Catastrophes of a natural origin
- Regulatory mandates
- Port shutdowns
- Vessel breakdowns
10. Privacy and Data Management
Your confidential information is managed in alignment with our Privacy Policy. Utilizing our offerings signifies your assent to the aggregation and application of your data as outlined within our Privacy Policy.
11. Proprietary Rights
All materials found on our website, including text, visuals, logos, and imagery, are safeguarded by copyright and trademark mandates. Unauthorized reproduction, distribution, or derivation is strictly prohibited sans our prior written consent.
12. Governing Law
The application of these Terms is in accordance with the laws in force within France. Any disputes shall be subject to resolution within the jurisprudence of the courts in Nice, France.
13. Amending Terms
The amendment of these Terms is reserved as per our discretion. Any revisions will be announced via our online platform with the date of revision being updated. Persistent use of our services post-modification signifies agreement to the altered terms.
